There is a certain consensus in administrative doctrine about the advisability of introducing a generalized second instance in the administrative litigation process. A broad conception of the second instance requires openness to the review of both the legal and factual aspects of the judicial reasoning of the first instance judgment. However, for this to be possible, it is necessary to abandon the subjectivist conception of evidence and proof, which is currently the majority view in administra-tive case law, and to give the principle of immediacy the appropriate content, in accordance with the rational conception of evidence and proof ​
