La limitació de la responsabilitat de l’hereu pels deutes del causant i l’acceptació de l’herència a benefici d’inventari

Abstract

"The aim of this work is to analyze the responsibility that the heir must face as a result of the acceptance of the inheritance that has been referred to him. Acceptance of the inheritance affects simply and directly the personal estate of the heir, in order that he is committed to the payment of debts and hereditary charges. A guaranteed solution to this problem would be to offer greater protection to the heir, without involving his own property, limiting his liability. This situation of helplessness of the heir was considerably aggravated on account of the economic crisis suffered on 2008, which created a new debate for the reform of civil legislation in the indicated sense. Therefore, acceptance for the benefit of inventory should be analyzed as a possible solution to the heir’s unlimited liability, defining the requests so the heir can benefit from it, as the effects that derive from the mentioned benefit, which are opposite to the pure and simple modality of acceptance."

"La finalitat d’aquest treball és l’anàlisi de la responsabilitat a la que ha de fer front l’hereu com a conseqüència de l’acceptació de l’herència que li ha estat deferida. L’acceptació de l’herència pura i simplement afecta directament el patrimoni personal de l’hereu, de manera que aquest queda compromès al pagament dels deutes i càrregues hereditàries. Una solució garant a aquesta problemàtica seria oferir una major protecció a l’hereu, sense involucrar els seus propis béns, limitant la seva responsabilitat. Aquesta situació de desemparament de l’hereu es va agreujar considerablement amb la crisi econòmica soferta a partir de l’any 2008, fet que va obrir un nou debat per a la reforma de la legislació civil en el sentit indicat. Així doncs, s’haurà d’analitzar l’acceptació a benefici d’inventari com una probable solució a la responsabilitat il•limitada de l’hereu, definint els requisits que normativament es marquen perquè l’hereu s’hi pugui acollir, així com els efectes que es deriven del citat benefici, els quals són contraris a la modalitat d’acceptació pura i simple.”
