This article aims to contribute to the issue raised with respect to the European
citizenship for the new national Catalans on the assumption that Catalonia becomes a new
state. Several questions arise: Does the acquisition of a new nationality imply the loss of the
European citizenship? Are there any vested rights? In case these rights are lost, since when?
In order to address these questions, we will analyse the link between European citizenship
and nationality, as well as the consequences on citizenship if Catalonia secedes from Spain.
This study will take into account the jurisprudence of the Court of Justice of the European
Union defending its competence to ensure compliance with European citizenship according
to EU law. Two additional questions follow from this analysis: firstly the obligation to
negotiate in case of secession, and secondly the possibility that the European citizenship has
gone a step further evolving to a new concept. The result of the referendum in the UK adds
a new scenario which is also contemplated
Aquest article vol ser una aportació a la qüestió que es planteja respecte a la ciutadania
europea per part dels nous nacionals catalans en el supòsit que Catalunya esdevingués
un nou estat. Davant l’adquisició d’una nova nacionalitat es perd aquesta condició (la de ser
ciutadà europeu)? Hi ha uns drets adquirits? I en el cas que es perdessin, des de quan? Per
intentar donar resposta a aquestes qüestions s’analitza el vincle entre la ciutadania europea
i la nacionalitat, així com quines podrien ser les conseqüències amb relació a la ciutadania
si Catalunya se separés de l’Estat espanyol. Per a aquesta anàlisi cal tenir en compte la jurisprudència del Tribunal de Justícia de la Unió, que va defensant la seva competència
per garantir el respecte de la ciutadania europea, en ser un dret atorgat per l’ordenament
jurídic comunitari. Les conclusions dels apartats anteriors ens condueixen a plantejar-nos
dos aspectes més: d’una banda, l’obligació de negociar si tingués lloc la situació plantejada,
i de l’altra, la possibilitat que la ciutadania hagi fet un pas més i puguem situar-nos en un
nou concepte d’aquesta. El resultat del referèndum al Regne Unit afegeix un nou escenari
que també es té en compte
