Female genital mutilation is a historical and cultural practice that severely violates the human rights of women and children, constituting a form of gender-based violence. This research analyses the practice from various perspectives, addressing the phenomenon from a socio-cultural standpoint, as well as its regulation across different dimensions, with an emphasis on the national context. Through a bibliographic and jurisprudential review, the limited enforcement of existing legislation in practice is highlighted, along with the need to strengthen preventive and participatory approaches to combat the phenomenon. Finally, the study presents a proposal for improvement that stresses the need to adopt a tolerant and inclusive perspective as a key element in the eradication of the practice
