Orígenes, validez y efectos de la inclusión de seguros obligatorios como mecanismos de compensación de daños

This work reflects on the notion of mandatory insurance as a hybrid instrument for damage management, questioning its validity in Colombia and seeking to contribute to the proposal of a legislative and public policy method that allows for evaluating its relevance and monitoring its operation. Although mandatory insurance is already a widespread instrument in much of the world, in the Colombian case, there is no legal framework that defines the necessary procedure for its implementation, as well as its evaluation and periodic control. Furthermore, it highlights that, although its creation is stipulated to be reserved for law, it has been corroborated that this single requirement has not always been met, and different regulations have been used to create or require it, causing contradictions and casting doubt on the legitimacy of its implementation. The final section analyzes the effects of these contradictions on the legal dynamic and possible interpretive solutions for its application, evaluating the consistency of the Colombian legal system ​
