Israel identifies itself as a people that has suffered deeply from violence and persecution throughout its history. Paradoxically, it has been accused of reproducing dynamics of oppression and repression against the Palestinian people; a nation also marked by marginalization and expropriation. These actions have been identified as possible violations of international law, including accusations of war crimes. The conflict between Palestine and Israel constitutes one of the most persistent and complex challenges in the field of international relations and public international law. Its protracted and multidimensional nature has generated numerous legal and political controversies, especially in matters of international justice. This conflict has been addressed by both the International Court of Justice (ICJ) and the International Criminal Court (ICC). It is from this scenario that the present final degree project arises, with the aim of analyzing how the International Criminal Court addresses the Palestine-Israel case. The main objective is to understand
what powers this court has and how it applies them, but also to explore to what extent it can really
be effective in the face of a conflict so fraught with political, legal and symbolic complexity.
This involves examining the regulatory framework that protects its action –especially through
the Rome Statute–, analyzing the potentially applicable international crimes, and assessing the structural and political limits that condition its capacity for effective intervention
