This paper analyzes Regulation (EU) No. 1215/2012 (Brussels I bis), which establishes rules on jurisdiction in civil and commercial matters within the European Union, focusing on consumer protection in cross-border disputes. It examines the rise of e-commerce in the EU and Spain, driven by digitalization and the COVID-19 pandemic, highlighting consumer profiles and purchasing trends. Despite progress, the Regulation shows limitations, such as the lack of protection for active consumers and collective actions, restricting its scope mainly to passive consumers. The conclusions stress the need for reforms to ensure effective and equitable access to justice
