Reconocimiento de derechos de indemnidad en el marco de la violencia obstétrica: hacia un daño moral con enfoque de género

This study aims to demonstrate, within the Colombian context, that extra-contractual civil liability does not compensate or repair the damages suffered exclusively, or predominantly, by women due to a lack of recognition of these damages. This is because the judicial process, as well as the sources of law and social dynamics themselves, are permeated by entrenched patriarchal and sexist practices that prevent damages assumed to be borne by women, by virtue of a social role and duty assigned to their sex, from being considered compensable. This is the case in medical civil liability proceedings for damages caused during childbirth and postpartum care and intervention, or for obstetric violence. Therefore, under these circumstances, it will be argued that civil liability requires a gender perspective -both procedurally and substantively- to guarantee effective and substantive justice for women ​
