ENG- The thesis examines tort law from a legal and philosophical perspective, interpreting it as a legal artifact whose architecture should considers its normative structure, functions, and the errors that may arise in its design and implementation. It argues that the purpose of tort law is to establish a just interpersonal normative framework and that its implementation within a legal system can be assessed through its functions and dysfunctions. Thus, it is emphasized that, as a matter of principle, the authorities, when designing and implementing the tort law, must ensure a balanced fulfillment of their functions, giving prima facie priority to the distinctive function, in alignment with the normative and social context. This work contributes to the theoretical and normative debate on tort law, particularly regarding its reform in response to emerging social dynamics
