The Spanish criminal process is configured by two clearly defined phases: the preliminary
investigation and the oral trial. However, between these two, another procedural stage called
“intermediate phase” is blurred, the existence of which is debated by the doctrine and the
criticisms and proposals related to its configuration are more than controversial. On this point, the
recent Draft Criminal Procedure Code of 2020 offers innovative solutions in relation to the status
and representation of this procedural phase with an autonomous character, although there are still
issues that remain to be resolved
