This paper analyzes the liability in tort of health providers for the unwanted administration of life-sustaining treatments. In these cases, a competent patient drafts an advance directive or similar documentation expressing his refusal, under certain circumstances, to artificial life-sustaining treatments. Despite this, the health provider breaches the directive and applies a non-wanted life-prolonging medical treatment. This article addresses the conflict between the patient's right to life and his right to self-determination, from the perspective of the European Court of Human Rights case-law and the experience of German and US courts in the so-called action for wrongful living. It also looks at Spanish law and proposes solutions covering the current lack of criteria in Spanish case-la ​
