Adscribir y reaccionar. Una concepción interpersonal sobre responsabilidad

Abstract

ENG- The investigation is centered in the concept of responsibility and its main objective is to perform a reconstruction of it. Because it is a basic concept in Legal Theory, several problems are encountered by whoever wants to address it. First, because it is used in many different contexts in different ways, being necessary a clarification about the different senses in which expressions such as “responsibility” and “being responsible” are used, as are the relations between them. Secondly, because coming from different philosophical grounds, divergent ways of understanding responsibility emerge. This urges for an identification and clarification of the conceptions adopted by different philosophers and the place that the concept of responsibility has in them.

In this thesis, both needs are satisfied under the hypothesis that they are connected and it moves forward the development of an interpersonal and reactive conception of responsibility. It is interpersonal, because it suggests that a satisfactory way of understanding responsibility is by assuming it stands from elements of social life that cannot be reduced to individually considered persons, but constituted from the relations between them. It is reactive because, in contrast with the predominant ideas about it in the last centuries on the topic, it is defended that reactions (i.e. sanctions in a wide sense understood as expressions of reactive attitudes) are constitutive of responsibility practices.

The structure of this work is composed by three parts. The first one introduces the object of study and the discussions around it. The main meanings which expressions as “being responsible” or “responsibility” have are assessed, and a discussion of which of those meanings is primary is introduced. In the second part, the grounds of this debate are examined, by studying the philosophical postulates adopted by the participants of that debate, and also the doctrines in which their postulates rely on. Particularly, two conceptions are identified: an intrapersonal one or agent-based and an interpersonal one or practice- based. In the third part, it is proposed a way of understanding responsibility based on its structure as an exchange between persons, where relations between action of ascribing and reacting play a central role

CAT- La investigació es centra en el concepte de responsabilitat i el seu objectiu principal és realitzar-ne una reconstrucció. Essent aquest un concepte bàsic dins la filosofia del dret, qui pretén enfrontar-s’hi es troba davant diversos problemes. En primer lloc, perquè és utilitzat de diverses maneres en múltiples contextos, essent necessari un aclariment sobre els diferents sentits amb els que s’utilitzen expressions com “responsabilitat” o “ser responsable”, així com les relacions que sorgeixen entre ells. En segon lloc, perquè a partir de varis fonaments filosòfics sorgeixen diverses formes de comprendre la responsabilitat que alhora entren en conflicte entre elles. Això fa menester identificar i aclarir les concepcions adoptades pels diversos filòsofs i la posició que ocupa el concepte de responsabilitat en elles.

En aquesta tesi es satisfan ambdues necessitats sota la hipòtesi que es troben connectades i s’avança en el desenvolupament d’una concepció sobre la responsabilitat interpersonal i reactiva. És interpersonal perquè suggereix que una forma satisfactòria de comprendre la responsabilitat és assumint-la a partir d’elements de la vida social que no poden ésser reduïts a característiques de persones individualment pensades, sinó en tant que constituïdes en les relacions entre elles. És reactiva perquè a diferència de les idees predominants en els darrers segles sobre el tema, aquesta tesi defensa que les reaccions (i.e. sancions en un sentit ampli, enteses com a expressions d’actituds reactives), són constitutives de la pràctica d’atribució de responsabilitat.

L’estructura del treball ve conformada per tres parts. La primera d’elles introdueix l’objecte d’estudi i les discussions que pivoten al seu voltant. S’estudien els principals significats amb els que s’utilitzen expressions com “ésser responsable” o “responsabilitat” i es presenta una discussió respecte de quin d’aquests significats és primari. En la segona part del treball es revisen les bases d’aquesta discussió estudiant els postulats filosòfics que subscriuen els actors participants en ella, així com les doctrines que sostenen aquests postulats. Particularment s’identifiquen dos concepcions: una d’intrapersonal o basada en l’agent i una d’interpersonal o basada en pràctiques socials. En la tercera part es proposa una forma d’entendre la responsabilitat a partir de la seva estructura com un intercanvi entre persones on les relacions entre les accions d’adscriure i reaccionar compleixen un rol central
