This study focuses on the analysis of consent as an essential element for the protection of sexual freedom, within the framework of the new Law 10/2022, well-known as the “only yes is yes” law. With the introduction of this law, the conceptualisation of consent in the Spanish Criminal Code has been reformed and debates have arisen about its validity and how it should be proven in criminal proceedings. The study examines the new model of consent, practical cases where its existence or absence is verified, as well as the vices that invalidate it. The main objective is to understand how consent is determined in sexual offences and how the jurisprudence, in particular that of the Supreme Court, assesses and evaluates these cases ​
