Falses tensions jurídiques entre el dret a la propietat privada i el dret a l'habitatge. La problemàtica de l'ocupació; un repte d'estat

Abstract

Throughout the work, the existing problem between the right to private property and the right to housing will be analyzed and studied, as well as its causes. The main factors that influence this current dynamic will be identified, and possible ways of reconciliation or solution to the conflict will be explored. The aim of this study is to understand the current situation from different points of view and evaluate the exploration of possible solutions to the problem. The study will focus on the legal framework that governs employment situations in Catalonia, on the current legislation, the relevant case law and the opinion of well-known and prominent personalities in the matter. The aim is to provide a complete and contextualized vision of the Catalan reality, far from the polarized discourses that contribute to social fragmentation and increased political tension. We will put on the table the dichotomy of what is legitimate and what is not, in cases where the right to decent housing is justified as an argument for occupying someone else's property

Al llarg del treball s'analitzarà i s'estudiarà la problemàtica existent entre el dret de la propietat privada i el dret a l'habitatge, així com les seves causes. S'identificaran els principals factors que influeixen en aquesta dinàmica actual, i s'exploraran possibles vies de reconciliació o solució del conflicte. Es pretén, amb aquest estudi, comprendre la situació actual des dels diferents punts de vista i avaluar l'exploració de possibles solucions a la problemàtica. L'estudi se centrarà en el marc jurídic que regeixen les situacions d'ocupació a Catalunya, en la legislació vigent, la jurisprudència rellevant i l'opinió de personalitats enteses i destacades en la matèria. Es pretén donar una visió completa i contextualitzada de la realitat catalana, allunyada dels discursos polaritzats que contribueixen a la fragmentació social i a l'augment de la tensió política. Posarem sobre la taula la dicotomia sobre allò que és legítim i el que no ho és, en els casos que es justifica el dret a l'habitatge digne, com a argument per ocupar una propietat aliena
