This Final Degree Project (FDP) focuses on two large blocks. On the one hand, it focuses on the study
of the rights of victims of human trafficking in criminal procedure in Spain, in addition to some
problems that may have arisen, the outstanding jurisprudence or the comparison of theory with
applied reality. We will see the different phases that a victim goes through from the moment of
identification until the corresponding compensation is granted.
On the other hand, with the desire that this project stands out for its topicality, I will carry out a
complete and detailed analysis of the Draft Comprehensive Organic Law Against Trafficking and
Exploitation of Human Beings as an impulse of Spain’s Government; which after falling in the
previous legislature due to the call for elections, was approved this past March 8, 2024 by the Council
of Ministers. A joint balance will therefore be made with the European regulations to prove if it is
really a useful document or a political move by the Government, studying the new developments it
provides with the help of the Report of the Regulatory Impact Analysis of this preliminary draft,
published on April 20, 2024
