La insuficiencia de mecanismos de denuncia efectiva ante la vulneración de derechos fundamentales en los procedimientos de deportación de extranjeros

Although there are more and more international institutions that advocate the implementation of reporting mechanisms for the violation of fundamental rights in deportation proceedings, in the Spanish legal system there is no specific mechanism in situations of detention, incarceration and expulsion of foreigners, with administrative and generic criminal procedures being the only option. However, the right to legal defence is ineffective, suspended or non-existent at various stages of the sanctioning process and border control. This article will discuss the main conflicts that basically affect the fundamental right to judicial protection, concluding by showing the need for enabling reporting mechanisms, and increasing the institutional and judicial zeal for guaranteeing the effectiveness of said right as a sine qua non condition for the reporting of rights violations. Future mechanisms cannot be devised without being aware of the current situation, pointing out normative gaps, police malpractice and violations of existing fundamental rights ​
