Desacuerdos teóricos e interpretación del derecho

Abstract

In a relatively recent article, Giovanni Battista Ratti criticized the way the problem of legal disagreements was treated in Anglo-Saxon scholarship. Also, he presented an alternative reconstruction of the phenomenon in which most disagreements are ideological instead of theoretical. In our opinion, Ratti's paper benefits from the conceptual instruments of Genoese legal realism to clarify the problem and to point out important matters as much as it drags its shortcomings, given that some of his distinctions are questionable and lead him to unduly exaggerate the controversial character of law. Within the framework of a hartian positivist theory, we argue that the best explanation of legal disagreements is based on noticing that there are different levels of disagreement and that not all of them have the same nature

En un trabajo relativamente reciente, Giovanni Battista Ratti ha criticado el tratamiento que el problema de los desacuerdos en el derecho ha recibido por parte de los teóricos anglosajones. Asimismo, ha presentado una reconstrucción alternativa del fenómeno según la cual la mayoría de los desacuerdos son ideológicos y no teóricos. En nuestra opinión, del mismo modo en que Ratti se beneficia del instrumental del realismo genovés para clarificar el problema y señalar puntos importantes, también arrastra sus limitaciones, ya que algunas de sus distinciones son cuestionables y le llevan a exagerar injustificadamente el carácter controvertido del derecho. En el marco de una teoría positivista hartiana, argumentamos que la mejor explicación de las controversias jurídicas se basa en reconocer que hay distintos niveles de desacuerdo y que no todos tienen la misma naturaleza
