Sufrimiento y cárcel: un acercamiento histórico, teórico y etnográfico

Abstract

ENG- The main objective of this research is to deepen the understanding of the suffering inflicted by imprisonment. Through a historical, theoretical, and ethnographic perspective, our aim is to comprehend the act of inflicting suffering within the prison context as an emotional phenomenon involving the agent with the intent to inflict suffering, the victim, and the convicted. Thus, in this research we analyze the elements of inflicted suffering, as well as the intention, the way in which it is executed, the representative content, and the outcome. The above is done with the purpose of examining this phenomenon from a legal perspective, exploring, and questioning the limits of inflicted pain and its purposes. The research highlights that the suffering inflicted upon women takes on a dimension distinct from that of men, primarily due to the role played by social stereotypes related to the female gender. From this difference, we analyze the experiences of women in prison. In this regard, it becomes evident that the inflicted suffering, as it is currently conceived, fails to achieve the objectives set forth by the law and, instead, results in meaningless suffering that exacerbates social violence. Furthermore, throughout the analysis, it becomes apparent that restorative justice mechanisms could potentially serve as an alternative to imprisonment, as their nature corrects some of the elements that makes ineffective the suffering within prison

CAT- L'objectiu principal d'aquesta recerca és aprofundir en el coneixement del patiment infligit per la pena de presó. Des d'una perspectiva històrica, teòrica i etnogràfica, es busca comprendre el fer sofrir de la presó com un fenomen emotiu en el qual intervenen l'agent que té la intenció de causar sofriment, la víctima i el condemnat. Així, s'analitzen els elements del patiment infligit, la intenció, la forma, el contingut representatiu i el resultat, amb la finalitat d'examinar aquest fenomen des d'una perspectiva jurídica, de manera que s'explorin i es qüestionin les dimensions del dolor infligit i els seus fins. La recerca posa de manifest que el patiment infligit a les dones adquireix una dimensió que difereix de l'experiència dels homes, la qual es deu al paper que juguen els estereotips socials que existeixen sobre el gènere femení. Des d'aquesta diferència s'analitza l'experiència de les dones a la presó. En aquest sentit, es posa de manifest que el patiment infligit, tal com està concebut, no pot complir amb les finalitats proposades pel dret i, en canvi, resulta en un patiment sense sentit que augmenta la violència social. A més, al llarg de l'anàlisi es desprèn que els instruments de justícia restaurativa podrien presentar-se com una alternativa a la pena de presó, ja que la seva naturalesa corregeix alguns dels elements que fan que el patiment a la presó no condueixi al penediment ni a la reconciliació social
