Oralidade sem imediaçao na prova civil

Abstract

La investigación averigua el vínculo entre los principios de la inmediación y de la oralidad en la formación y valoración de la prueba en el proceso civil, buscando proponer solución para dos cuestionamientos: (1) ¿la prueba testimonial realizada sin la inmediación judicial o sin la inmediación del juez que juzga la causa, tiene valor epistémico diferente de la realizada bajo la mirada del juez?; y (2) Con las herramientas y conocimientos que hoy día tenemos a respeto de la prueba oral, ¿ necesitamos que esa prueba se realice únicamente frente a un juez para que se considere confiable y válida? Las respuestas proponen un avance en la calificación y eficacia de la producción y valoración de la prueba testimonial, apoyada en elementos de la psicología del testimonio, de conceptos de epistemología y filosofía jurídica, en correlación con la doctrina procesal civil

This research investigates the link between the principles of immediacy and orality in the production and evaluation of evidence within the field of civil procedure, seeking to propose a solution to two questions: (1) does testimonial evidence gathered without judicial immediacy or without the immediacy of the judge trying the cause have an epistemic value distinct from that gathered under the eyes of the judge?; and (2) with the tools and knowledge about oral evidence available for us today, do we need it to be carried out only in front of a judge to be considered reliable and valid? The answers to these questions propose an advance in the qualification and efficiency of the production and evaluation of testimonial evidence, supported by elements of the psychology of testimony, concepts of epistemology and legal philosophy, in correlation with the prevailing opinion of civil procedure scholars
