The illegal transfer or abduction of minors represents a complex and delicate problem that involves international law and raises legal, ethical and social questions of considerable importance. The phenomenon is not new, however, the growing globalization and mobility of people have conferred an increasingly pressing relevance and have created legal complexity at the level international as it is necessary to compare different legal systems to obtain a effective and coherent response. This work aims to examine the phenomenon from a complete vision, focusing on the factors that may contribute to and cause child abduction, in particular by conducting an analysis. Comparative of the regulatory systems between Spain and Italy. The main national and international legal instruments will be analyzed, such as in particular the 1980 Hague Convention, which deals with this problem. Special attention will be paid to the rights and well-being of the minors involved who are be the victims of this phenomenon because they are the ones on whom geographical distance is imposed, uprooted from their own family, social and school environment that can lead to problems not indifferent and that is why it is important to never forget the supreme interests of minors ​
