La preparación del testimonio: un falso mantra, cargado de riesgos epistémicos

There are many and very serious problems affecting testimonial evidence. If anything comes from the studies of the psychology of testimony, is that. Son muchos y muy serios los problemas que aquejan a la prueba testimonial. Si algo se deriva de los estudios de la psicología del testimonio es justamente ello. Por el carácter secreto en el que se realiza, por la limitada confrontación que al respecto puede adelantar la contraparte y porque implica una injerencia directa en el contenido del relato, la preparación del testigo es uno de esos problemas. Quizás uno de los más graves. Aunque un sector de la doctrina anglosajona y latinoamericana afirma a modo de máxima que los abogados deben preparar a los testigos, son pocos los esfuerzos rigurosos por precisar el concepto, sus límites y los riesgos que conlleva para la búsqueda de la verdad y los abogados que intervienen en el proceso. Este trabajo, a través de un análisis epistémico y de una propuesta de regulación detallada, constituye un primer esfuerzo por superar ese vacío
