Gender identity, especially in cases where it differs from the sex assigned at birth, has led to important debates in different fields. One of them is precisely that of the judicial process. This text aims to analyze the criterion adopted by the Superior Chamber of the Electoral Tribunal of the Federal Judiciary to limit the objective of seeking the truth to protect a set of fundamental rights in those cases in which gender identity is questioned. In this regard, I will maintain that the sacrifice of such an objective is not justified, unless in light of the court’s considerations. Likewise, I will defend that, even admitting that it is, said criterion faces significant problems in terms of evidence that cast doubt on the relevance of the evidentiary rules imposed by the court for this type of dispute ​
