La prueba grafotécnica: fundamentos, validez y fiabilidad

Abstract

Expert evidence is currently of great importance in decision making. Its uncritical re-ception and lack of empirical data has been of great concern, given its potential for error. In this context, graphotechnical evidence requires special analysis, since it has been received and used uncritically as a valid and reliable methodology. The purpose of this paper is therefore to analyze the empirical foundations of the graphotechnical expert evidence; that is, to know if we have in-formation on the validity and reliability of these procedures, to address their methods and, finally, to know how they actually work. This study addresses the theoretical premises and foundations of graphotechnical evidence, and offers an account of the methodologies, techniques and those «laws» on which this technique is based; from this, we will investigate and conclude on its operation to know if it empirically measures what it intends to measure

La prueba pericial actualmente reviste trascendencia en la toma de decisiones. Su recep-ción acrítica y la falta de datos empíricos ha provocado mucha preocupación, dada su posibilidad de error. Especial atención exige, en este contexto, la prueba grafotécnica, ya que se ha recibido y utilizado acríticamente como una metodología válida y fiable. Es, pues, objeto de este trabajo analizar cuáles son los fundamentos empíricos de la prueba pericial grafotécnica; es decir, conocer si disponemos de información sobre la validez y fiabilidad de estos procedimientos, abordar sus métodos y, en fin, conocer cómo funcionan. En este estudio se investigan las premisas teóricas y fundamentos de la prueba grafotécnica, y se repasan también las metodologías, técnicas y «leyes» en las cuales se sustenta. A partir de ese análisis se extraerán algunas conclusiones sobre su funcio-namiento para conocer si empíricamente mide lo que pretende medir
