L'Ocupació il·legal d'habitatges: una problemàtica sense fi?

Abstract

Els fenòmens d’ocupació il·legal d’habitatges han anat in crescendo en els últims anys, especialment a Catalunya. Aquesta complexa problemàtica ha estat abordada des de nombroses perspectives ja sigui sociològiques, politològiques, econòmiques i, evidentment, legals. Centrant-nos en la nostra disciplina, la intensa producció normativa i les posteriors interpretacions jurisprudencials fan més que necessària una sistematització de quines són les accions a l’abast dels posseïdors legítims enfront els ocupants, els principals trets que les caracteritzen i els desafiaments que es plantegen en la seva aplicació

The phenomena of illegal occupation of homes has been on rise in the last years, especially in Catalonia. This complex issue has been approached from numerous sociological, political, economic and, obviously, legal perspectives. Focusing on our discipline, the intense regulatory production and subsequent jurisprudential interpretations make more than necessary a systematization of what are the available actions to legitimate owners against occupiers, the main features that define them and the challenges in their application. All in order to question if they are efficient enough to deal with it
