This paper addresses the problem of the difficult proof in the Public Law Litigation from the perspective of the Law & Economics. It is proposed to study the incentives that our evidentiary systems generate on the conduct of the parties and their propensity to achieve the true determination of the facts as an institutional objective proper to that type of cases ​
