La investigación en el proceso civil: hacia una nueva ordenación de los mecanismos de averiguación de hechos y de obtención de fuentes de prueba

The paper discusses whether the Spanish civil procedural law offers effective tools to conduct investigations about facts and to obtain evidence and, where appropriate, to what extent these tools meet the needs of those seeking judicial relief. In addition, the issue is examined in two law systems, the US federal and the German. Unlike US law and other Common Law systems with the discovery, the legal tradition of the continental Europe is rather reluctant, if not openly hostile, to admit the parties to conduct investigations about facts and evidence in civil process. The comparison of these opposing models will allow making proposals regarding the Spanish Law, among others, the need to institute a single and uniform procedural channel in order to allow a true investigation of facts and sources of evidence, provided some specific requirements are met ​
