The article attempts to make explicit the reasons why current criminal justice systems are deficient in providing adequate criteria for determining when the factual premises of judicial decisions are sufficiently justified. Using a series of distinctions drawn from the field of Epistemology and the Philosophy of Language, it elucidates the reasons for this deficiency and shows what obstacles any attempt seeking to solve the problem must face. From there, the text reconstructs the two main lines of thought that, at present, try to provide the adequate tools to overcome those obstacles ​
