Available empirical evidence shows that the stage of preparation of trial (intermediate
procedure or stage) in the Chilean criminal procedure have not fulfill in the real operation of the
system its role as being a serious instance of admissibility control of evidence that the legislator attempted to establish. There are several indicia that low quality evidence is admitted to trial without
any questioning. This work presents the evidence and analyses the reasons that could explain this
phenomenon. In addition, formulates some preliminary proposals oriented toward the transformation of this stage of the procedure in a real instance of admissibility control. This is in light of
information that suggest that the same problem is also present in other Latin American countries
