Cassation appeals may be analyzed from very different points of view, as indeed they have been. Their purposes sometimes outstretch the legal sphere, such as the powers of the highest court and the need of such a high commitment to co-exist with an efficiency that achieves the objectives for which it was conceived and these now constitute one of the most hotly debated issues. These opinions may include other doctrinal arguments, especially regarding the constitutional scope and philosophy of law, and also justice, questioning the advisability of examining and eventually incorporating other legal traditions such as the US method in order to achieve case law doctrine that truly adapts to changing social realities. This work seeks to address an approach to the issue of these aspects by highlighting different points of view that may contribute to lay the basis for sufficiently weighing up legislative options of great importance ​
