This article examines the recent reforms of the Consultatives Councils in Spain.
Formally, it is divided into two parts. Firstly, this paper examines the recent abolition of the
Consultatives Councils in Madrid and Extremadura, and the legal reforms that have affected
the Consultative Council in Galicia and the Council for Statutory Guarantees of Catalunya.
On this basis, the second part of the article analyzes the legal and political arguments put
forward to defend these new regulatory frameworks. To do so, it reviews the constitutional
limits and some political and academic debates about the decentralization process of the
consultative function in the State of Autonomies. This article concludes with a critical review
of the recommendations of the Commission for the Reform of Public Administration
L’article examina les darreres reformes normatives d’incidència en la regulació dels
consells consultius autonòmics. Formalment, es divideix en dues parts. A la primera, s’analitza
la recent supressió dels consells consultius a Madrid i Extremadura així com les reformes
recents que han afectat el Consell Consultiu de Galícia i el Consell de Garanties Estatutàries
de Catalunya. Partint d’aquesta base, a la segona part de l’article s’analitzen els arguments
jurídics i polítics esgrimits per justificar aquests nous marcs normatius. Per fer-ho, l’article
analitza els límits constitucionals i els debats polítics i acadèmics projectats en el procés
de descentralització de la funció consultiva a l’Estat autonòmic. L’article conclou amb una
lectura crítica de les recomanacions de la Comissió per a la Reforma de les Administracions
Públiques d’incidència en la matèria
